Terms and Conditions of Bookings
The below terms and conditions relate to bookings with Cousins Sail Sports Ltd directly.
For booking made directly with North Oxford Marine Training (a trading name of Cousins Sail Sports Ltd), please see relevant Terms and Conditions here.
Terminology in the below policy:
Provider - Refers to Cousins Sail Sports Ltd or a person acting on it's behalf.
Instructor/Trainer - Qualified RYA Instructor/Trainer provided by Cousins Sail Sports Ltd
Client - Refers to Person(s), Organisation or Body booking services with Cousins Sail Sports Ltd
Cancellation Policy
All bookings made are final/non-refundable and/or invoice-able at 100% of the cost of the course if payment has yet to be made.
The exception to the above is in the below circumstances:
• Bookings which must be cancelled due to restrictions imposed by the government/relevant local authorities and/or owners of the water/water access areas where the course is scheduled to go head on are refundable for trainer/instructor days, if they have not already commenced. (Expenses already incurred are chargeable at full rate).
• Cousins Sail Sports Ltd reserves the right to cancel the booking for any unforeseen circumstances up to and including the date of the training course. For example, but not limited to; storms, flooding, high winds, shortage of water or illness of instructor/trainer where no replacement instructor/trainer can be found in time. In these circumstances’ bookings are refundable for trainer/instructor days not yet used, if they have not already commenced. (Expenses already incurred are chargeable at full rate).
• If the client cancels the booking with more than 6 weeks’ notice and a subsequent booking can be found in its place then a full refund or partial refund (dependent on number of days un-recoverable) will be provided, or no invoice sent to the client (depending which is relevant).
In addition to the above exception the provider may cancel a booking or refuse to allow any trainee or group of trainees to participate in the proposed training if, the provider deem them to be not suitable on the grounds of; age, ill-health, inexperience, suspected influence of alcohol or drugs, irresponsible behaviour, abusive behaviour or any reason that may affect the safety of any person, or the commercial interests of the provider. This extends to personnel involved directly with training and/or arrangement of training at the centre in question. In these circumstances no refund will be offered.
Fees/Payments
At time of booking customers will be provided with a quote related to the delivery of their required service.
Standard terms of payment are 14 days from point of invoice issue.
If other unanticipated expenses are incurred in relation to the delivery of the service originally quoted - then the expenses incurred will be charged back to the client via means of invoice - either adding this to any unpaid invoice, or creating a new one to cover this. Examples of such unanticipated expenses include, but are not limited to, parking charges, launching fees, visa requirements (for overseas clients), un-used/non refundable transportation costs no longer usable, cancelation charges etc.
Regualar/preferred payment method is via bank transfer to the Cousins Sail Sports Ltd bank account.
Card payments are possible - but the provider reserves the right to charge a card payment fee at cost of processing this payment back to the client. Further details can be provided on enquiry.
Insurance
The client is also responsible for all insurance matters relating to running the relevant course - including appropriate Public Liability Insurance, Employers Liability Insurance and Craft Insurance. By confirming a booking with Cousins Sail Sports Ltd, the client is also affirming that the provider or those operating on it's behalf are insured to helm & take charge of the centre's vessels issued to them for training (including, but not limited to, Dinghies, Windsurf Kit, Personal Watercraft, Powerboats etc).
In the event of an insurance claim the client will also be responsibile for covering the cost of any insurance excess - which will be non chargable back to the provider.
RYA Recognition - For RYA Recognised Courses & Instructor Courses
Cousins Sail Sports Ltd provides freelance water sports coaching to individuals and organisations, and well as providing capacity to existing, recognised RYA Centres, in order to run RYA courses.
Due to the above, Cousins Sail Sports Ltd or persons acting on it's behalf booked to delivery RYA Training are doing so under the Client's RYA Training Status and it's Insurance. On this basis Cousins Sail Sports Ltd or anyone acting on it's behalf are in effect instructors of that particular RYA Training Centre for the duration of the booking. As such, clients are responsible for ensuring the instructor/trainer has been provided with the correct induction procedures and/or appropriate briefings enabling them to carry out their duties safety and efficiently within the scope of the SOP's that centre operates on.
At bare minimum - it is expected that the Cousins Sail Sports instructor/trainer will be provided with an up-to-date copy of; Local SOP's Risk Assessments and Health and Safety policy, related to RYA training at that site.
Where requested, Cousins Sail Sports will provide copies of all relevant professional qualifications related to the course being run either in PDF form or via the 'MY RYA Portal.' An examples of this would be a First Aid Instructor Certificate and Valid First Aid Certificate when acting as a First aid Instructor for the client.
The client is responsibly for all booking procedures/processes related to getting candidates onto the course - including ensuring appropriate joining instructions and such are sent out in advance in a timely manor.
